Terms of service

The deal between you and WeFlok, in plain language.
Draft. This text hasn't been reviewed by a lawyer yet. Highlighted parts still need to be filled in.
1. About these terms
These terms are an agreement between you and [WeFlok's registered company name] ("WeFlok", "we", "us"), [address], Ontario, Canada. They apply when you use the WeFlok website or app.
By creating an account you agree to these terms, our Privacy policy and our Community rules. If you don't agree, please don't use WeFlok.
2. What WeFlok is
WeFlok helps people who commute the same way share a car and share the cost. Drivers post the commute they already drive; riders book a seat.
WeFlok is a meeting place, not a transport company. We don't drive, own or control any car. Drivers are private people sharing their own trip, not our employees, agents or contractors, and they aren't taxi or rideshare drivers.
Each trip is an arrangement between the driver and the rider. We aren't a party to it, and we don't promise that any trip will happen.
3. Who can use WeFlok
- You must be at least 18 years old.
- You use your real name and a real photo of yourself, and keep your details up to date.
- You have one account, and you keep your password private. You're responsible for what happens in your account.
- You don't use WeFlok if we suspended or removed you before.
4. Extra rules for drivers
When you offer seats, you confirm that, for every trip:
- you hold a valid driver's licence for the car you drive, and you aren't a novice driver under conditions that ban passengers;
- the car is insured, registered and safe to drive, and the details you gave us (make, model, colour and plate) are correct;
- your car insurance covers you for carrying riders who share the cost of a commute. Check with your insurer before your first trip. WeFlok doesn't provide insurance for trips;
- you follow the law and our Community rules, and you never drive impaired, tired or holding a phone;
- you only carry as many riders as you listed, and every rider has a seatbelt.
We may ask for your licence and insurance and check them, but checking documents doesn't mean we vouch for you or your car.
5. Sharing costs, not making a profit
WeFlok is for sharing the cost of a trip you're making anyway, not for earning a living. To keep it that way:
- prices are per seat and can't go over WeFlok's maximum for the trip's distance;
- a driver only offers trips on their own regular commute, and doesn't use WeFlok to run a taxi, delivery or other business;
- drivers don't ask riders for more money, inside or outside the app.
Drivers are responsible for any taxes on what they receive. We may change price limits to stay within the law.
6. Booking and paying
A booking is confirmed when the driver accepts it, or straight away if the driver takes instant bookings. The price you see when you book is the price of the seat, plus home pickup if you chose it.
Riders pay through WeFlok by card, using our payment provider [Stripe]. WeFlok may charge riders a service fee, which is always shown before you book. Drivers receive their share after the trip, by the method set up in their account. [Payments are added before launch; until then this section describes how they will work.]
Keep payments in WeFlok. Paying or asking for payment by cash, e-transfer or any other way outside the app isn't allowed, and you lose WeFlok's help if something goes wrong.
7. Cancelling
Plans change. Cancel in the app as early as you can, so the other person can make other plans.
- Cancelling a confirmed seat less than 2 hours before the trip counts as a late cancellation and shows on your profile.
- Round trips: drivers are paid for a rider's day once the rider is back home. If a driver cancels a rider's ride home, the driver isn't paid for bringing them in that morning either, and the rider is refunded for both.
- If a rider cancels their ride home, the driver is still paid for the morning.
- [Refund amounts for rider cancellations, once payments are live.]
8. Problems with a trip and refunds
If something went wrong, either person can report a problem with the trip in the app within 14 days. We ask the other person for their side, look at the trip details and messages, and decide whether the rider gets a full, part or no refund and whether the driver is paid.
We try to be fair to both sides, but our decision is final as far as payments through WeFlok go. It doesn't take away any rights you have under the law.
9. Your content and reviews
You own what you post (your photo, bio, messages, reviews). You let us show it in WeFlok and use it to run the service, for as long as it's in your account and as the Privacy policy describes.
Reviews must be honest and about the trip. We may remove content that breaks these terms or our Community rules, and our filter blocks phone numbers, emails, banking details and offensive words in messages and profiles.
10. Safety
In an emergency, call 911. WeFlok isn't an emergency service.
You're responsible for your own decisions about who you ride with. Use the profiles, reviews, chat and Share my trip to decide, and follow the safety tips on our Safety page. We don't run criminal record or driving record checks unless we say so on a member's profile.
11. Suspending or closing accounts
We may warn, suspend or remove anyone who breaks these terms or our Community rules, puts others at risk, or misuses WeFlok. A suspended member's upcoming trips are cancelled. Serious or illegal behaviour may be reported to police.
You can close your account at any time by emailing support@weflok.co. [In-app account deletion is planned.]
12. Limits of our responsibility
We work hard to keep WeFlok running and safe, but we provide it as it is. We don't promise it will always be available or error-free, or that members are who they say they are.
As far as the law allows, WeFlok isn't responsible for what happens during a trip, including accidents, injury, loss or damage, delays or no-shows, or for what members do or say. Claims about a trip are between the people involved and their insurers.
As far as the law allows, our total responsibility to you for anything to do with WeFlok is limited to the greater of the fees you paid WeFlok in the 12 months before the claim and $100.
Nothing in these terms limits rights you have as a consumer that the law says can't be limited.
13. Your responsibility
If you break these terms or the law while using WeFlok and someone makes a claim against us because of it, you agree to cover our reasonable costs, as far as the law allows.
14. Changes to these terms
We may update these terms as WeFlok grows. We'll tell you about important changes in the app or by email before they take effect. If you keep using WeFlok after that, you accept the new terms.
15. Law and disputes with WeFlok
These terms are governed by the laws of Ontario and of Canada. If we have a disagreement, please contact us first at support@weflok.co; most things can be sorted out quickly. Otherwise, the courts of Ontario decide, unless the law where you live gives you the right to go to your local courts.
